Personal Bankruptcy & Debt Restructuring Schemes in Cyprus

Legal avenues to resolve unserviceable bank debts in Cyprus: Personal Repayment Plans (PRP), Debt Relief Orders (DRO), bankruptcy discharge, and legal protection of primary residences.

This is not legal advice.

Engage a licensed Insolvency Practitioner for a Personal Repayment Plan (PRP)

Under the Personal Insolvency Law, debtors unable to service debts negotiate consensual or court-imposed Personal Repayment Plans (PRPs) through a licensed Insolvency Practitioner. A court-sanctioned PRP legally restructures loan terms, reduces interest rates, writes off unsecured debt, and stays creditor enforcement actions.

Documents required at this step:Statement of affairs, comprehensive debt and asset schedule, bank loan contracts, income tax returns

Utilize Debt Relief Orders (DRO) for qualifying low-income debtors

Debtors with unsecured debts under €25,000, minimal disposable income (under €200/month after living expenses), and assets under €1,000 can petition the court for a Debt Relief Order. Successful completion grants an absolute legal discharge of all eligible liabilities after 12 months.

Documents required at this step:Proof of monthly living expenses, unemployment or social benefit receipts, bank statements for past 12 months

Invoke primary residence protection against bank foreclosures

Under statutory mortgage and insolvency relief frameworks, debtors residing in properties valued under statutory thresholds can petition the court to shelter their primary home from repossession, provided they contribute towards adjusted sustainable mortgage installments assessed against standard reasonable living standards.

Documents required at this step:Title deed of primary residence, independent valuation report, household income substantiation

FAQ

Does personal bankruptcy cancel all types of debts in Cyprus?

No. Bankruptcy discharge does not release liabilities for child maintenance arrears, court fines, damages arising from fraud or personal injury, or debts incurred following the bankruptcy adjudication.
