Buying Property in Cyprus: Step-by-Step Legal Procedure

How to verify Title Deeds, check developer mortgages at the Land Registry, apply for 5% reduced VAT, and deposit your Sale Agreement for Specific Performance protection.

This is not legal advice.

Independent Legal Due Diligence & Search Certificate

Before signing any reservation agreement or paying a deposit, instruct an independent CBA-verified advocate (not affiliated with the developer or agent) to obtain an official Search Certificate from the District Land Registry confirming whether pre-existing mortgages, memos, or planning violations exist.

Documents required at this step:Copy of Title Deed, architectural & planning permits, developer company search

Drafting the Contract of Sale & Bank AML Clearance

Your lawyer negotiates payment milestones, bank waiver clauses (if a developer mortgage exists), and prepares the Source of Funds (AML) package required by Cyprus banks.

Documents required at this step:Passport, tax returns / dividend statements, bank statements (last 6–12 months)

Contract Stamping & Deposit at Land Registry (Specific Performance)

Within 6 months of signing, the contract must be deposited at the District Land Registry under Law 81(I)/2011. This locks your legal right to the property and prevents the seller from reselling or mortgaging it.

Documents required at this step:Signed Contract of Sale, Tax Clearance, Council of Ministers application (for non-EU buyers)

FAQ

Do I legally need a lawyer to buy property in Cyprus?

While not strictly mandatory by statute to sign a private agreement, under Cyprus Law only a licensed CBA advocate may charge a fee for drafting legal instruments relating to immovable property, and independent encumbrance verification at the Land Registry is essential to avoid developer mortgage traps.
